Cerbone v. Diocese – Defamation/Whistleblower Retaliation

Following a two week trial in Sacramento County, a jury found the Diocese liable for retaliating and defaming the Plaintiff. Only four months into the job, head football coach Christopher Cerbone reported sexual hazing among student athletes at Saint-Patrick Saint-Vincent High School in Vallejo, California. The Diocese terminated his employment almost immediately after receiving his report, and publicly defamed him by reporting to over 20 media outlets that he was “ultimately responsible” for supervision during the time the hazing occurred. The jury awarded $900,000.00 in damages for emotional distress and harm to reputation and found the Diocese acted maliciously. After arguments concerning punitive damages, the Diocese stipulated to a $4 million judgment against it.

After a six week trial in Alameda County, a jury found Farmers liable for failing to engage in a good-faith interactive process and failing to accommodate Plaintiff’s disabilities resulting from her breast cancer treatments. The jury also found that Farmers failed to prevent discrimination, harassment, and retaliation.

Flowers v. TLC – Disability Discrimination/Defamation

Plaintiff Miresha Flowers alleged that she was terminated unlawfully while on protected medical leave. After nearly 20 years of employment, she was fired on Christmas Eve for allegedly “abusing” the disabled women she had spent nearly her entire adult life caring for. It was not until Mr. Clark received a key admission, that Ms. Flower’s did not “abuse” these women, did Defendant offer to pay $209,145 (nearly nine years wages) plus all reasonable attorneys’ fees and costs.
